It has come to the attention of Kenya Revenue Authority that there are goods whose clearance is still pending, sometimes up to one month from date of our official authorization through the Simba 2005 System to effect duty payment.
Importers, exporters and clearing agents are requested to note that Section 249 of the East African Community Customs Management Act (CMA) states as follows: “Where an amount of duty or other sum of money which is due under this Act remains unpaid after the date upon which it is payable, an interest of two per cent per month or part of the date upon which it is payable, an interest of two per cent per month or part of the month, of the unpaid amount shall be charged.”
Failure to pay the requisite duties and taxes after authorization for payment through Simba 2005 System shall henceforth attract a penalty in accordance with the foregoing provision. In addition, goods that remain unentered after twenty-one (21) days from the date of arrival are subject to customs warehouse rent.
